The use by Eastern Suffolk BOCES of a Behavior Intervention Room (BIR) shall be governed by the policies, rules, and standards pursuant to 8 New York Code of Rules and Regulations (NYCRR) Section 200.22(c) of the Commissioner’s Regulations. Pursuant to Commissioner’s Regulations, a time out room (referred to herein as a “BIR”) is defined as “an area for a student to safely deescalate, regain control, and prepare to meet expectations to return to his/her educational program.”
ESBOCES will maintain a regulation governing the use of BIRs as part of its behavior management approach, consistent with Commissioner’s Regulations, including the physical space and monitoring requirements, parental rights, and Individualized Education Program (IEP) requirement for students with disabilities.
The Director of Special Education shall be responsible for establishing administrative practices and procedures for training all staff responsible for carrying out the provision of the Commissioner’s Regulations relating to the use of BIRs. The Director of Special Education shall establish and implement procedures to document the utilization of BIRs, including information to monitor the effectiveness and use of the BIRs to reinforce alternative appropriate behaviors. Such data would be subject to review by the State Education Department upon request.
